Mark is a genuine litigation all-rounder with a breadth of experience across all areas of dispute resolution (as can be seen below), his specialism is property litigation.

  • Regularly acting on behalf of an electricity distributor in relation to the resolution of complex disputes involving its property and apparatus. These include attempts by landowners to obstruct access to its equipment and apparatus, interference with easements, breaches of covenants, general advice on the interpretation of wayleave agreements and the Electricity Act 1989.
  • Dilapidation claims including the successful resolution, on behalf of a multi-national tenant client, of a high value dilapidations claim (in addition to several others) involving factually and legally complicated issues.
  • Advising clients in the education sector on handling a variety of student complaints (such as alleged breaches of the Equality Act and the alleged misuse of powers leading to judicial review proceedings) and data subject access requests.
  • Providing strategic and legal advice on other commercial landlord and tenant issues including lease renewal proceedings, the exercise of break notices and the interpretation of commercial leases.
  • Advising on the existence and enforceability of various land rights in addition to the enforcement, protection and preservation of such rights.

  • Acting for a trading subsidiary of a charity which generates income for the charity through a property portfolio in relation to repossession claims.
  • Assisting the firm’s real estate department with frequent litigation advice and guidance for the firms largest clients on difficult issues.
  • Major claims involving insolvency issues, including the defence and pursuit of high value claims by liquidators and administrators against former directors.
  • The pursuit of bankruptcy proceedings against a former director in a case that was reported (Day v Refulgent [2016] EWHC 7) following a fraudulent misrepresentation claim and a worldwide freezing order.

  • Advising a bespoke and complex manufacturer client in relation to high value disputes with customers concerning the supply of the company’s products, often involving difficult jurisdictional issues.
  • Advising clients on the protection, preservation and enforcement of intellectual property rights.

  • Managing, for a variety of large commercial clients, complex and simple debt recovery claims including the pursuit of enforcement action such as charging orders, orders for sale, winding-up and bankruptcy petitions.

Mark particularly enjoys visiting the Lake District and days out with his young family. When he still gets a chance, he enjoys watching and playing a wide variety of sports from football to hockey.
